Terms of Use

These Terms of Use ("Terms") are the terms of service that governs our relationship with users and others who interact with the UJA's Walk with Israel Website ("Website"). By using or accessing the Website, you agree to these Terms, as updated from time to time.

1.       Privacy

Your privacy is very important to us. We encourage you to read the UJA's Walk with Israel Privacy Policy and our General Privacy Policy, and to use it to help you make informed decisions.

2.       Fundraising via the Website

Every community member plays an important role helping raise money. Funds raised through the Website will support the people in Israel. Funds raised for Israel needs are allocated to Jewish Federations of Canada-UIA.

Fundraising through the Website is a simple easy-to-use crowdfunding application that can be easily promoted via social media services, websites and email.

 

3.       Eligibility

If you are not 16 years old, you are not eligible to use the Website without the consent and supervision of your parent or legal guardian who is at least 16 years old, provided that your parent or legal guardian also agrees to be bound by these Terms and agrees to be responsible for your use of the Website.

 

4.       Sharing Your Content and Information

You own all of the content and information that you post on the Website. Once you upload content and information, the following terms will apply

4.1.    For content that is covered by intellectual property rights, like photos and videos (IP content), you specifically give us the following permission: you grant us a non-exclusive, transferable, sub-licensable, royalty-free, license to use any IP content that you post on or in connection with the Website (IP License). This IP License ends when you delete your IP content or your account unless your content has been shared with others, and they have not deleted it.

4.2.    When you delete IP content, it is deleted in a manner similar to emptying the recycle bin on a computer. However, you understand that removed content may persist in backup copies for a reasonable period of time (but will not be available to others).

4.3.    When you publish content or information, it means that you are allowing everyone to access and use that information, and to associate it with you (i.e., your name and profile picture).

 

5.       Safety

We do our best to keep the Website safe, but we cannot guarantee it. We need your help to keep the Website safe, which includes the following commitments by you:

5.1.    You will not post unauthorized commercial communications (such as spam) on the Website.

5.2.    You will not collect users' content or information, or otherwise access the Website, using automated means (such as harvesting bots, robots, spiders, or scrapers) without our prior permission.

5.3.    You will not upload viruses or other malicious code.

5.4.    You will not solicit login information or access an account belonging to someone else.

5.5.    You will not bully, intimidate, or harass any user.

5.6.    You will not post content that: is hate speech, threatening, or pornographic; incites violence; or contains nudity or graphic or gratuitous violence.

5.7.    You will not use the Website to do anything unlawful, misleading, malicious, or discriminatory.

6.       Registration and Account Security

The Website users provide their real names and information, and we need your help to keep it that way. Here are some commitments you make to us relating to registering and maintaining the security of your account:

6.1.    You will not provide any false personal information on the Website, or create an account for anyone other than yourself without permission.

6.2.    If we disable your account, you will not create another one without our permission.

6.3.    You will not use your personal fundraising page for your own commercial gain, and will use the Website for such purposes.

 

6.4.    You will keep your contact information accurate and up-to-date.

6.5.    You will not share your password (or in the case of developers, your secret key), let anyone else access your account, or do anything else that might jeopardize the security of your account.

6.6.    If you select a username or similar identifier for your account or personal fundraising page, we reserve the right to remove or reclaim it if we believe it is appropriate (such as when a trademark owner complains about a username that does not closely relate to a user's actual name).

7.       Protecting Other People's Rights

We respect other people's rights, and expect you to do the same.

7.1.    You will not post content or take any action on the Website that infringes or violates someone else's rights or otherwise violates the law.

7.2.    We can remove any content or information you post on the Website if we believe that it violates these Terms or our policies.

 

8.       Amendments

 

8.1.    If we make any changes to policies referenced in or incorporated by these Terms, we may provide notice on this page.

8.2.    Your continued use of the Website following any such changes constitutes your acceptance of our amended terms.

9.       Termination

If you violate the letter or spirit of these Terms, or otherwise create risk or possible legal exposure for us, we can stop providing all or part of the Website to you. In all such cases, these Terms shall terminate, but the following provisions will still apply: 2.1, 2.2, 3 and 5.

 

10.   Disclaimer

We take great care with our Services and we endeavour to keep them accurate, error-free, and free of any offensive material. However, you use the site at your own risk and we will not be liable for any costs or losses you incur through your use of the Website. Whilst we may include on the Website links to third party websites or resources, we are not responsible for such third parties and you use those websites or resources at your own risk.

 

11.   Definitions

 

11.1.By "information" we mean facts and other information about you, including actions taken by users and non-users who interact with the Website.

11.2.By "content" we mean anything you or other users post on the Website that would not be included in the definition of information.

11.3.By "data" or "user data" or "user's data" we mean any data, including a user's content or information that you or third parties can retrieve from the Website.

11.4.By "post" we mean post on the Website or otherwise make available by using the Website.

11.5.By "use" we mean use, run, copy, publicly perform or display, distribute, modify, translate, and create derivative works of.

11.6.By "personal fundraising page" we mean your public profile created by you and which will be viewable by all users.

 

12.   Other

 

12.1.These Terms are an agreement between you and UJA Federation of Greater Toronto and/or United Jewish Appeal of Greater Toronto.

12.2.These Terms make up the entire agreement between the parties regarding the Website, and supersedes any prior agreements.

12.3.If any portion of these Terms is found to be unenforceable, the remaining portion will remain in full force and effect.

12.4.If we fail to enforce any of these Terms, it will not be considered a waiver.

12.5.Nothing in these Terms shall prevent us from complying with the law.

12.6.We reserve all rights not expressly granted to you.

 

UJA'S WALK WITH ISRAEL PRIVACY POLICY

 

UJA Federation of Greater Toronto and United Jewish Appeal are committed to protecting your privacy and the confidentiality of any personal information which you provide to us.

 

This Privacy Policy describes UJA's Walk with Israel policies and procedures on the collection, use and disclosure of your personal information in connection with the Walk with Israel, including in connection with the Walk with Israel website ("Website") and uses terms that are defined in the Website's Terms of Use. You may find additional information in our General Privacy Policy (the "General Privacy Policy").

 

By accessing the Website or the mobile Website and providing your information you indicate your acceptance of this Privacy Policy and the General Privacy Policy, as amended from time to time.

 

1.       Collection of personal information:

You may provide personal information to us for a variety of reasons, including to receive general information, to fundraise, to make a donation, to receive information about or become involved in promotions or other initiatives undertaken by the Website. This personal information may include (without limitation) details such as your name, image, audio and video recording, address, mobile number, e-mail address, employer or business or the amount you have donated (the "Personal Information"). If you make a donation you may provide us with credit card details and other information which will allow us to process the transaction. We may also request your preferences for receiving further information about the any fundraising campaign or outcomes from the funds raised.

 

The choice of how much information you provide is yours and of course if you want to use the Website, make a donation, or otherwise participate in our programmes and events, the Website will require certain information from you.

 

2.       How do we use the Personal Information?

We may use the personal information you provide through the Websites for the following purposes:

·         to provide you with information or other communications about Walk with Israel.

·         to involve you in our events, programmes, future campaigns and other initiatives via email or otherwise.

·         to include your image, name and details on the Website if you fundraise (unless you chose to limit the public view of your information, as described below).

·         to include your name, comments and amount of donation on our Websites if you make a donation (unless you chose to limit the public view of your information, as described below).

·         to enter you into automatic prize draws if you fundraise and meet the relevant draw criteria

·         to analyse statistics.

If you choose to provide your personal details you agree that your personal information may be displayed or included as set out above. You also agree that your personal details may accordingly be identified, recovered and displayed by internet search engines. In certain circumstances we may give you the option to limit the public view of your information, for example:

Your Personal Fundraising Page - you have the option to choose how your name will be displayed in the Website. This means that we will endeavour to ensure that your full name is not available to general internet search engines and is inaccessible by a general search of our Services. However, you should also be aware that even if your full name is not displayed you personal fundraising page and your personal information will be available as follows:

·         to users that search for you in the "Donate/Sponsor" section of the Website;

·         if you belong to a team, then your team members that are logged in will be able to view your name; and

·         through a direct link to your personal fundraising page.

Please be aware that if you start with a personal fundraising page without limiting the option to display your full name and then change your preference to limit the display settings of your name, your personal fundraising page may have already been indexed by a search engine and may therefore appear in searches conducted on that search engine.

Your donations - your name and amount of your donation will be displayed on the Website, including on the recipient's public and private view of their personal fundraising page. However, you have the option to choose how your name will be displayed in the Website, including the public and private view of the recipient's personal fundraising page.

3.       Communication preferences:

We may use your personal information to send you emails about the Walk and the outcomes achieved with the funds raised. If you opened an account, the Website will automatically send you an email whenever there is activity on your personal fundraising page or updates to your donations.

4.       Links to other websites:

We are not responsible for the privacy practices or content of any other website or service that is linked to the Website, or for the privacy practices of any third party social media or other service providers that you can access through a Website. We encourage you to read the privacy policies of those websites and/or service providers.
